Terms of sale
Version 5. What you buy with a Yumwi subscription, and your rights. This is a translation provided for information. The French version is the one that applies; in case of difference, it prevails.
1. Seller
- Mathieu Vincenti EI, sous le nom commercial Yumwi, sole trader
- 138 avenue Victor Hugo, 75016 Paris, France
- SIRET 131 411 498 00010
- Email: contact@yumwi.com
- Phone: 06 95 82 38 87
- VAT not applicable, article 293 B of the French General Tax Code.
- Called "Yumwi" below.
2. Scope
These terms of sale govern paid subscriptions sold on yumwi.com to consumers and non-professionals ("the subscriber"). Use of the service itself is governed by the terms of use; on the subscription, these terms prevail.
They can be read, saved and printed at any time from the legal menu at the bottom of each page and from the order summary. The version that applies is the one accepted when ordering; it is emailed with the order confirmation.
3. Offers and prices
The Hub subscription gives access to all Hub features described on the Pricing page at the time of the order, mainly:
- customising every detail of the page: colours, frames, fonts, image or video background, patterns, gradients;
- unlimited videos, music and playlists, and unlimited large cards;
- photo albums and downloadable PDFs, in the quantities shown on the Pricing page;
- chat, contact form, mailing list and calendar;
- detailed statistics from the start, with export; the media kit;
- removal of the "Join … on Yumwi" mention at the bottom of the page; access to the referral programme.
- Prices: 7.99 € a month, or 59.88 € a year, i.e. 4.99 € a month, paid at once. Prices are in euros, all taxes included; VAT is not applicable (article 293 B of the French General Tax Code). The price paid is the one shown when ordering.
- Referral discount. An account created through the link of a creator who is a partner of the Yumwi referral programme gets a 20% discount on its first subscription payment, if that creator is a partner at the time of the order. The discount applies only once per account and only to the first payment: renewals are paid at the displayed price. It does not apply to a change of billing period, cannot be combined with any other discount and cannot be exchanged for money. The order summary shows the discounted amount before payment. In case of withdrawal, the amount refunded is the amount paid.
4. Who can order
- You must be 18 or older and declare it when ordering.
- Orders are only open to subscribers living in the countries listed in annex 3. Elsewhere, the free Hub remains available but orders are refused.
5. Free trial
- A free 14-day trial of the Hub is offered once per account. It starts without a bank card and without commitment, and nothing is paid during the trial.
- Without an order, the trial stops by itself on its end date. Nothing is charged, and the page returns to the free plan.
- To continue, the subscriber places an order (article 6), during the trial or after it. An order placed during the trial ends it: the first period starts on the day of payment.
6. Ordering
- 1. The subscriber chooses the offer and period (month or year).
- 2. A summary shows the offer and its total price for the period, the date of the first payment, automatic renewal, how to cancel and the right of withdrawal.
- 3. The subscriber ticks acceptance of these terms and the declaration of being 18 or older; they may also ask for the service to start right away (article 10).
- 4. They confirm their order with the "Pay" button, which commits them to pay.
- 5. They enter their card on Stripe's secure payment page.
- 6. The order is confirmed on screen, then by an email repeating the contract information, with these terms attached.
- Before confirming, the subscriber can go back at each step and correct their choice. The contract is concluded when the payment is recorded; the free trial, without commitment, forms none. The contract is concluded in French.
7. Payment
- Payment is by card, collected by Stripe Payments Europe. Yumwi never sees or keeps the card number.
- It is charged at the order, then at each renewal. An invoice is issued for each payment, available from My account.
- If a payment fails, Stripe retries it and the subscriber is notified by email. Without payment after these retries, the subscription stops and the page returns to the free plan.
8. Term and renewal
- The subscription is concluded for one month or one year, as chosen. It renews automatically, for the same period and at the same price, until cancelled.
- The subscriber can switch from monthly to yearly, or yearly to monthly, from My account, by placing a new order (article 6): the new period starts when the current one ends, without proration, and is paid that day.
- This change is concluded when its order is confirmed, not when it is paid: the withdrawal period of article 10 runs from that day. Withdrawing before the current period ends cancels the change: the subscription continues as before and nothing is charged. After that date, the subscription stops and the payment for the new period is refunded in full.
- For the yearly subscription, Yumwi informs the subscriber by a dedicated email, no earlier than three months and no later than one month before the renewal date, that they may choose not to renew; it gives the deadline, the amount and the cancellation link.
- If this reminder is not sent, the subscriber may cancel free of charge at any time after renewal; the part paid in advance for the remaining period is then refunded within 30 days.
- Articles L215-1 to L215-3 and L241-3 of the French Consumer Code are reproduced in annex 2.
9. Price changes
- A price change is announced by email at least 30 days before it applies. It only affects a running subscription at its next renewal. A subscriber who refuses it cancels before that date, free of charge.
10. Right of withdrawal
The subscriber has 14 days to withdraw, without giving a reason and free of charge, from the day the contract is concluded (article 6; article 8 for a change of period): that day does not count, the period ends at midnight (Paris time) on the 14th day, and if it ends on a Saturday, a Sunday or a public holiday, it runs until the next working day.
To withdraw: online, with the "Withdrawal" link, in My account, throughout the period, leading to a summary then the "Confirm withdrawal" button. Or by any unambiguous statement sent to contact@yumwi.com or by post to the address in article 1, for example with the model form in annex 1.
Yumwi acknowledges receipt of the withdrawal by email without delay, stating its content, date and time.
The subscription stops at once. Yumwi refunds the sums paid within 14 days of the withdrawal at the latest, by the same payment method.
If the subscriber asked for the service to start right away, they pay for the part of the service provided until the withdrawal, pro rata of the days elapsed; the rest is refunded. Otherwise, everything is refunded.
11. Cancellation
- The subscriber cancels at any time from My account, in two steps: "Unsubscribe", then "Confirm cancellation". They can also cancel from Stripe's billing page.
- Yumwi confirms the cancellation by email: date of the request, date the subscription ends, and what it changes.
- The subscription stays open until the end of the paid period, which is not refunded, except for withdrawal (article 10) or the case in article 8.
- During the withdrawal period that follows the subscription (article 10), cancelling counts as withdrawal: the subscription stops at once and the payment is refunded on the terms of article 10. The same goes for deleting the account.
- Nothing is deleted at the end of the subscription: the page returns to the free plan, what goes beyond it is hidden, and a new subscription brings it back.
12. Legal guarantees
Yumwi provides a service that conforms to the contract and its description. The subscriber benefits from the legal guarantee of conformity of digital content and services (articles L224-25-12 and following of the French Consumer Code) throughout the subscription.
In case of non-conformity, report it to contact@yumwi.com. The subscriber is entitled to have the service brought into conformity free of charge within a reasonable time; failing that, to a price reduction or termination of the contract with a refund of the period concerned.
13. Changes to the service
- Updates needed to keep the service in conformity, including security updates, are provided free of charge.
- Yumwi may change the service beyond those updates, at no cost to the subscriber, for a valid reason: technical change, security, legal obligation, change of provider, improvement of the service.
- If a change reduces access to or use of the service more than marginally, the subscriber is told by email at least 30 days before. They may then terminate free of charge within 30 days of the change, and the part paid for the remaining period is refunded.
14. Availability
Yumwi does what is needed to keep the service accessible at all times. It may briefly interrupt it for maintenance or an update, outside peak hours where possible.
If the paid service is inaccessible for more than 7 consecutive days because of Yumwi, the subscriber may terminate; the part paid for the remaining period is then refunded.
15. Liability
- Yumwi is liable for the proper performance of the service sold, under the conditions set by law.
- It is not liable for content published by the subscriber or other creators, of which it is only the host, for sites a Hub links to, or for an impediment due to force majeure.
- Nothing in these terms limits the rights the law guarantees to consumers.
16. Personal data
What Yumwi collects for the order and payment, why, for how long and how to exercise your rights: see the Privacy page.
17. Complaints and mediation
For any complaint, write to contact@yumwi.com or call 06 95 82 38 87. Yumwi answers as soon as possible.
In accordance with the French Consumer Code provisions on consumer dispute mediation, after contacting Yumwi and failing a satisfactory answer, the subscriber may use a consumer mediation procedure free of charge with:
- CM2C, 49 rue de Ponthieu, 75008 Paris, France
- Phone: 01 89 47 00 14
- Website: https://www.cm2c.net/declarer-un-litige.php
- Email: litiges@cm2c.net
- within one year of their written complaint to Yumwi.
18. Governing law and courts
- These terms are governed by French law.
- A subscriber living in another country keeps the protection of the mandatory rules of that country's law, where more favourable.
- In a dispute, the subscriber may bring the matter, at their choice, before the court of the place where they lived when ordering or where the damage occurred, or any other court competent under the law.
19. Changes to these terms
- A new version applies to orders placed after it goes online. For a running subscription, it is emailed at least 30 days before the next renewal, and the subscriber may cancel before that date.

Annex 2: articles L215-1 to L215-3 and L241-3 of the French Consumer Code (official French text)
Article L215-1.
